Acceptable Use Policy

Applies to: All users of RealeContracts, LLC, including brokerage firms, managing brokers, associate brokers, transaction coordinators, clients, and other invited participants.

This Acceptable Use Policy (“AUP”) applies to your access to and use of the real estate transaction software, website, and related services provided by RealeContracts, LLC (“RealeContracts,” “we,” “us,” or “our”). This AUP is incorporated into the Terms of Service by reference and governs all users of the platform, regardless of role or affiliation.

1. Scope of Users

This AUP applies to:

  • Real estate brokerage firms and their managing brokers.
  • Associate brokers and agents.
  • Transaction coordinators and office staff.
  • Buyers, sellers, and other parties invited to participate in a transaction.
  • Any other person who accesses the Service through a RealeContracts account, invitation, or transaction coordination role.

All users must comply with this AUP and the Terms of Service, as well as applicable laws, brokerage policies, and professional standards.

2. Permitted Use

You may use the Service only for lawful, legitimate purposes related to real estate transaction drafting, document management, collaboration, communication, workflow, and electronic signature functions. This includes:

  • Preparing, reviewing, and signing transaction documents.
  • Managing transaction timelines, deadlines, and metrics.
  • Coordinating among brokers, buyers, sellers, lenders, title companies, and transaction coordinators.
  • Using AI-assisted features as support tools, subject to verification and review.

3. Brokerage Firm and Broker Responsibilities

If you are a brokerage firm or broker (managing or associate):

  • You are responsible for ensuring that all users invited through your account have the right to access and use the Service for the relevant transaction.
  • You must set appropriate permissions and roles (e.g., managing broker, associate broker, client, transaction coordinator).
  • You are responsible for reviewing transaction documents and ensuring that electronic signatures are appropriate and authorized.
  • You must ensure that your use of the Service complies with Colorado real estate laws, brokerage rules, and applicable licensing requirements.

4. Transaction Coordinator and Staff Responsibilities

If you are a transaction coordinator or other staff member:

  • You may use the Service only as authorized by the brokerage, managing broker, or account administrator.
  • You may not modify or sign documents on behalf of a broker or client without proper authority.
  • You must follow brokerage policies and instructions regarding document handling, communication, and transaction security.
  • You must not circumvent permissions or access controls to view or edit transactions you are not authorized to manage.

5. Client and Invited-Party Responsibilities

If you are a buyer, seller, or another invited party:

  • You may use the Service only within the scope of the transaction for which you were invited.
  • You must not share your login credentials with others or allow unauthorized users to access your account.
  • You must not modify or sign documents on behalf of the broker, lender, or title company without explicit authority.
  • You must consult a qualified professional for any legal or financial questions before relying on documents or AI-generated content.

6. Prohibited Use

All users may not, and may not help anyone else to:

  • Use the Service for unlawful, fraudulent, deceptive, or misleading activity.
  • Upload, transmit, or store content you do not have the right to use.
  • Misrepresent your identity, license status, brokerage role, or authority.
  • Share access credentials or use another person’s account without authorization.
  • Attempt to bypass permissions, access controls, or transaction restrictions.
  • Reverse engineer, copy, scrape, decompile, or interfere with the Service.
  • Introduce malware, viruses, ransomware, bots, or harmful code.
  • Send spam, phishing messages, or abusive communications through the platform.
  • Use the Service to harass, threaten, abuse, or discriminate against others.
  • Use the Service in a way that could compromise transaction integrity, confidentiality, or security.
  • Use the Service to practice law, provide legal advice, or represent that RealeContracts is providing legal advice.
  • Use AI features in a way that intentionally generates false, deceptive, or noncompliant transaction content.
  • Submit highly sensitive information into AI features unless you are authorized to do so and the data is appropriate for that feature.

7. Security and Access Rules

All users are responsible for:

  • Safeguarding their login credentials.
  • Not sharing passwords or allowing unauthorized access.
  • Promptly notifying us of any suspected unauthorized access, account compromise, or security incident.
  • Ensuring that all users on their account understand and comply with this AUP.

8. Transaction Integrity

All users must:

  • Ensure that documents are complete, accurate, and reviewed before signing.
  • Confirm that all parties have the authority to sign and that signatures are intended.
  • Follow applicable Colorado real estate laws and brokerage rules.
  • Not use the Service to alter or falsify transaction documents for unlawful purposes.

9. AI-Specific Restrictions

You may use AI features only as support tools. You must:

  • Independently verify AI-generated content.
  • Not treat AI output as final legal, brokerage, title, escrow, or compliance advice.
  • Avoid using AI to generate false or misleading information.
  • Ensure that AI use does not compromise transaction security or confidentiality.

10. Enforcement

We may investigate suspected violations of this AUP. If we determine that you violated this AUP or created a risk to the Service, other users, or a transaction, we may suspend, restrict, disable, or terminate access, remove content, or take other reasonable protective action, with or without notice where permitted by law.

11. No Waiver

Our decision not to enforce a rule in a particular instance does not waive our right to enforce it later.

12. Updates

We may update this AUP from time to time. The updated version becomes effective when posted unless otherwise stated.
